Welcome to Family Equity: Kids & Pets ("the App"). These Terms and Conditions ("Terms") govern your access to and use of the App for iPhone, iPad and Apple Watch, provided by Decoded Lemon ("we," "us," or "our").
By downloading, installing, or using the App, you ("the User") agree to be bound by these Terms. If you do not agree to these Terms, you must immediately uninstall the App and cease all use.
1. Eligibility and Apple Services
1.1. Eligibility: You must be at least 18 years old, or use the App under the direct supervision and consent of a parent or legal guardian.
1.2. Apple Account: The App uses Apple platform services, including iCloud, to store and sync your data. You are responsible for maintaining the security of your Apple Account and devices.
1.3. Compatibility: Features may require a supported version of iOS, iPadOS or watchOS, an active iCloud account, and an internet connection. Apple Watch features require a compatible paired device.
2. Nature of Service and App Data
2.1. Household Organizer: The App helps you organize children and pets, including schedules, activities, school pickups, health notes, medicine, feeding times, important dates, documents, reminders and household posts.
2.2. Multiple Households: You may invite other people to a household, join households shared with you, and switch between them. Only invite people you trust. Household members may see content you share within that household.
2.3. Your Content: Profiles, schedules, documents, posts and other information you add remain your content. You grant us only the limited technical rights required to operate, sync and display the App to you and the people you choose to invite.
2.4. iCloud: Private household data is stored and synced through your iCloud account. Availability, backup and recovery may depend on Apple services and your device settings.
3. Subscriptions, Payments, and Cancellations
3.1. Free and Premium: The free plan includes up to 2 children, 2 pets, 1 invited family member, and joining up to 2 households. Premium may unlock unlimited children and pets, unlimited family invites, additional households, and priority notifications.
3.2. Apple Billing: Premium is a subscription billed through your App Store account. Apple acts as the merchant of record, and we do not collect or store your payment-card details.
3.3. Renewal: Payment is charged on confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel a subscription in Settings > Apple ID > Subscriptions.
3.4. Refunds: Purchases and refund requests are governed by Apple’s App Store policies. We cannot issue App Store refunds directly.
4. Posts and Community Safety
4.1. Family Feed: Content posted to a family feed is intended for members of that household.
4.2. Public Feed: If you choose to post publicly, your content may be visible to other users. Public posts may be automatically reviewed or moderated for safety before publication. Moderation reduces risk but cannot guarantee that all inappropriate content will be detected.
4.3. Responsibility: You are responsible for content you submit and must have the right to share it, especially photographs, documents or information concerning children or other people.
5. Acceptable Use and Restrictions
You agree that you will not:
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Use automated scripts, bots, unauthorized scrapers, or other methods that interfere with the App or its services.
- Post unlawful, abusive, exploitative, defamatory, deceptive, or harmful content.
- Impersonate another person, invade someone’s privacy, or share sensitive information without permission.
6. Health and Reminder Disclaimer
The App is an organizational tool, not a medical, veterinary, childcare, legal, or emergency service. Reminders may be delayed or missed because of device settings, connectivity, Apple services, or other factors. Do not rely on the App as the sole method for time-critical medication, health, safety, school pickup, feeding, or emergency information.
7. Limitation of Liability and "As-Is" Disclaimer
7.1. No Warranties: The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that syncing, reminders, moderation, or other features will always be uninterrupted, error-free, or completely accurate.
7.2. Limitation of Liability: To the maximum extent permitted by applicable law, Decoded Lemon shall not be liable for indirect, incidental, special, or consequential damages, including loss of data or losses arising from missed reminders, unavailable services, moderation decisions, or reliance on information in the App.
8. Privacy
Family Equity is private by default. Household data is stored through iCloud and shared only with people you invite, while content you intentionally submit to the public feed may be processed for safety and shown publicly. Apple’s services are also governed by Apple’s own terms and privacy policies.
9. Suspension and Termination
We may restrict or suspend access to public or collaborative features where reasonably necessary to protect users, comply with law, investigate misuse, or maintain the service. You may stop using the App at any time and can remove App data using the available in-app and Apple platform controls.
10. Governing Law
These Terms and your use of the App shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in courts located in South Africa.
11. Changes to These Terms
We may modify these Terms as the App evolves. When a change is material, we will provide reasonable notice in the App or through another appropriate channel. Continued use after updated Terms take effect constitutes acceptance.
